Senate Concurrent Resolution 00-009: Background Checks - Gun Shows (VERY BAD) by Senator Pascoe. Requires a gun show vendor, prior to the transfer or attempted transfer of a firearm, to require a background check on the prospective transferee and to obtain approval of the transfer from the Colorado bureau of investigation. Requires a gun show promoter to arrange for the services of one or more licensed gun dealers to conduct background checks at a gun show. Prohibits the transfer of a firearm, if any part of the transaction occurred at a gun show, if a background check has not been conducted through a licensed gun dealer. (Proposed Colorado Constitutional amendment to do the same thing that the proposed SAFE Colorado initiative.)

Senate Bill 00-010: Lawsuits Against Firearms Manufacturers (GOOD) by Senator Teck and Representative Clapp. Prohibits any civil suit in tort, other than a products liability action, against a firearms or ammunition manufacturer or dealer or against any firearms trade association for damages arising from any physical injury, physical damage, or death caused by the discharge of a firearm or ammunition. Instructs the court to dismiss any such prohibited civil action and to award reasonable attorney fees to each defendant named in the action.

Senate Bill 00-089: Firearms Transfers and Age of Possession (VERY BAD) by Senator Hernandez. Requires ALL firearm transfers to have a Bureau of Investigation background check and limits possession of handguns and assault weapons to those 21 and older.

Senate Bill 00-125: CBI Firearms Background Check System (BAD) by Senator Owen and Representative Tool. Authorizes the Colorado bureau of investigation ("bureau") to serve as the state point of contact for implementation of the permanent provisions of the federal Brady law. Requires the bureau to transmit a request for a background check to the national instant criminal background check system ("NICS"). Directs the bureau to deny a firearm transfer if the transfer would violate federal or state law, including violent juvenile offenses. Senate Bill 00-152: Concealed Handgun Permits (Under Evaluation) by Senator Tebedo and Representative Dean. Recognizes the need for statewide standards for the issuance of concealed handgun permits. Declares the issue of concealed handgun permits to be a matter of statewide concern. Requires any police chief and any sheriff who chooses to issue permits to carry concealed handguns to establish a concealed handgun permit program for issuing permits within their jurisdictions. Authorizes each police chief and sheriff to issue a concealed handgun permit to anyone who is at least 21 years of age, is a Colorado resident, and meets specified firearms training requirements, so long as the applicant can legally possess a firearm under federal law and has not been convicted of or adjudicated for a felony or certain misdemeanors and the applicant is not subject to unresolved criminal proceedings, chronically or habitually using alcohol or controlled substances, a danger due to mental problems, or otherwise a danger to self or others. Specifies that any concealed handgun permit issued by this state, or by another state pursuant to a comparable statute, is valid in all areas of this state. Specifies that permits are valid for 4 years and may be renewed for subsequent 4-year periods.

Senate Bill 00-154: Defenses To Weapons Laws (GOOD) by Senator Tebedo. Changes the affirmative defenses to carrying a concealed weapon to exceptions. Clarifies the concealed weapons defense of carrying a weapon in a private car while traveling to include traveling from a point of origin to a destination and between a person's car and a building.

Senate Bill 00-166: Limits On Juvenile Access To Guns (VERY BAD) by Senator Pascoe and Representative Coleman. Prohibits unsafe storage of a loaded handgun or assault weapon by any person in control of a premises when that person knows or reasonably should know that a juvenile is likely to gain access to the handgun or assault weapon. Makes it a class 6 felony to unsafely store a loaded handgun or assault weapon if a juvenile obtains the handgun or assault weapon and uses it to commit an offense under state or federal law. Makes it a class 1 misdemeanor to knowingly sell to any person under twenty-one years of age an ammunition feeding device that accepts more than ten rounds of ammunition. Raises the age for legal handgun possession from 18 to 21 years of age. Prohibits persons under 21 years of age from possessing assault weapons.

House Joint Resolution 00-1008: Firearms Or Dangerous Devices In Capitol (GOOD) by Representative Clapp and Senator Musgrave. No person, including a member of the Legislature, shall bring a firearm or any other dangerous device into any area where the General Assembly meets or works without prior permission of the Speaker of the House and/or the President of the Senate. Does not apply to persons with a concealed carry permit or law enforcement officers. (Could this be in response to House Minority Leader Representative Gordan waving a pistol around during debate on the gun show bill?)

Requires identifying information concerning concealed weapon permit holders to be kept confidential. Includes materials and records concerning a concealed weapon permit within the definition of "criminal justice records" for purposes of the provisions concerning release of criminal justice records. Requires information identifying a concealed weapon permit holder to be deleted from a criminal justice record prior to release of the record.

House Bill 00-1197: Safe Storage of Firearms (BAD) by Representative S. Williams and Senator Perlmutter. Makes it a class 3 misdemeanor if a person negligently stores a firearm in such a manner that a juvenile obtains possession of the firearm and uses it to commit a criminal offense.

House Bill 00-1201: Weapon Possession by a Felon (GOOD) by Representative McElhaney. Increases the penalty for possession of a weapon by a felon from a class 1 misdemeanor to a class 6 felony. Requires the imposition of a mandatory, consecutive sentence. Requires that parole officers present all evidence in their possession to the district attorney for the purpose of prosecution, in addition to the required filing of a parole revocation complaint with the state board of parole, when any parolee is found in possession of a weapon.

House Bill 00-1214: Penalty for Straw Firearms Purchasers (NEUTRAL) by Representative Decker and Senator Sullivant. Makes it a class 3 felony for a person to purchase a firearm on behalf of or for transfer to a person who is ineligible to possess a firearm under federal or state law. Requires firearms dealers to post a sign informing the public of the prohibition, and makes it a class 3 misdemeanor for failure to post such information.

House Bill 00-1241: Previous Offenders Possessing Weapons (GOOD) by Representative Lee. Enhances the sentence for conviction of the crime of possession of a weapon by a previous offender. Excepts the crime of possession of a weapon by a previous offender from the offenses required to be bailable. Makes a parolee accused of such a crime ineligible for bail to be set within 72 hours after the defendant’s arrest. Disallows bail pending sentencing or appeal for persons convicted of such a crime.

House Bill 00-1243: Parental Consent For Firearms for Minors (GOOD) by Representative Lee. Prohibits any person from providing a firearm without remuneration to any person under the age of 18 years without the consent of the parent or legal guardian of the underage person. Deems the parental consent requirement to be satisfied either if the parent or legal guardian is present at and knowingly consents to the transfer or if the juvenile presents to the transferor a statement of express consent, signed and dated by the parent or legal guardian.

House Bill 00-1245: Weapons On School Property (VERY BAD) by Representative Windels. Eliminates the permit exception for carrying deadly weapons on school grounds. Eliminates the exception to carrying deadly weapons on school grounds that allows a person to have a deadly weapon if the person is in that person’s own dwelling or place of business or on property owned or under that person’s control at the time of the act of carrying the deadly weapon. Tightens the exception to carrying deadly weapons on school grounds that allows an unloaded weapon to remain inside a motor vehicle while upon the real estate of any public or private college, university, or seminary by allowing the exception to apply only to private motor vehicles. Expands the prohibition of weapons on school grounds to apply not only to real estate owned by a school, but also real or personal property owned or possessed by a school or school district.

House Bill 00-1247: Permitting Juvenile To Possess Handgun (Under Evaluation) by Representative Kaufman. Makes it an offense for any person, not just a parent or legal guardian, to fail to make reasonable efforts to prevent a juvenile from committing a violation with a handgun or to provide a handgun to or permit a juvenile to possess a handgun even though he or she knows the juvenile is likely to use the handgun to commit an offense.

House Bill 00-1272: Prohibited Gun Sales To Persons Under 21 (BAD) by Representative Gotlieb. Makes the sale of firearms other than rifles or shotguns by federally licensed importers, manufacturers, dealers, and collectors to persons under 21 years of age a class 4 felony.

House Bill 00-1289: Standardization Of Firearms Regulation (VERY GOOD) by Representative Hefley and Senator Hillman. Recognizes that firearms regulation is a matter of statewide concern. Prohibits any municipality, county, or city and county from adopting any ordinance or resolution that would impose a greater restriction on a person's ability to own, possess, carry, use, repair, manufacture, display, or transfer a firearm than is imposed by state law. Identifies imposition of a greater penalty as being a greater restriction. Specifies that any ordinance or resolution in existence as of the effective date of the act that violates the provisions of the act shall be deemed unauthorized and unenforceable on or after the effective date of the act.
