bullet Senate Bill 08-048:  Prohibit Automated Political Phone Calling (BAD) by Senator Keller (D-20) and Representative Buescher (D-55).  Prohibits political telephone solicitations made by automatic dialing machines or by paid political solicitors to anyone in Colorado or registered to vote in Colorado.  PPFC comment:  No one likes telephone solicitation calls, but this bill would further erode our political free speech.  Read Text of Bill (Requires Acrobat Reader)

bullet Senate Bill 08-115:  Concern a Civil Action for Damages Suffered in a Gun-Free Zone (GOOD) by Senator Brophy (R-01) and Representative Stephens (R-20).  Creates a civil action to enable a person who is injured in a gun-free zone to recover damages as a result of criminal conduct in the zone if a reasonable person would believe the possession of a firearm in the zone could have helped the person defend himself or herself. bullet House Bill 08-1066: Deadly Force Against an Intruder (GOOD) by Representative C. Gardner (R-63) and Senator Harvey (R-30).  Creates a presumption that an occupant who uses deadly physical force against an intruder has a reasonable fear of imminent death or serious bodily injury to himself or herself or another person. bullet House Bill 08-1096:  Prohibition on on the Intentional Confinement of Animals for the Purpose of Hunting (BAD) by Representative Stafford (D-40).  Prohibits a person from offering another person the opportunity to hunt, wound, or take any mammal that is intentionally confined, tied, staked, caged, or otherwise restrained from engaging in normal movement. Allows exceptions for slaughtering a mammal for purposes of meat, leather, or fur production or humanely euthanizing a mammal for health, safety, or scientific purposes. Establishes penalties. bullet House Bill 08-1137:  Wildlife Commission Acquisition of Property (UNDER REVIEW) by Representative Sonnenberg (R-65) and Senator Brophy R-01).  Requires the wildlife commission to sell land or water, or an interest in land or water, of equal or greater value when the commission acquires land or water, or an interest in land or water, by gift, transfer, devise, or purchase so that the division's total property assets do not grow above the division's total property assets as of a specified date.  Requires the commission to annually pay to any local government or public body corporate that is authorized to levy taxes upon land or water, or an interest in land or water, purchased by the commission a payment in lieu of taxes equal to the amount of tax the taxing entity would annually receive if the land or water, or interest in land or water, were owned by any private person or corporation.  Requires the commission to seek approval by the general assembly, acting by bill, of every purchase of any fee title interest in real property or any interest in water.  Read Text of Bill (Requires Acrobat Reader)

bullet House Bill 08-1190:  Eliminates requirement for CBI to be open for 12 hours on Sundays to process instant background checks (UNDER REVIEW) by Representative J. Kerr (R-28) and Senator Taylor (R-8).  Currently, CBI is required to be "open for business" (run background checks) for a minimum of 12 hours per day except for Thanksgiving and Christmas. The NICS "manual" requires state points of contact (CBI for us) to be open from 10:00am to 9:00pm Monday through Saturday and "normal retail business hours" (not defined) on Sundays.

HB08-1190 will modify the CBI required open hours to conform with the NICS requirement.  The impact of this change would depend on how "normal retail business hours" are defined for Sunday. I suspect there are very few FFLs that are open on Sundays after 5 or 6 pm. The stated purpose of the bill is to allow CBI to better utilize their personnel to staff up during higher background check times. On the face, this seems reasonable until the government defines "normal business hours" on Sunday to be something like Noon - 4pm.
