PETITION FOR REVIEW OF ACTION OF THE TITLE BOARD
IN THE MATTER OF THE TITLE, BALLOT TITLE AND SUBMISSION CLAUSE, AND
SUMMARY FOR PROPOSED INITIATIVE 1900 - 2000 #255 (1).

As a registered elector of the State of Colorado, I, William Bernard Herpin, Jr., request, pursuant to section 1-40-107(2), Colorado Revised Statutes, as amended, that the Supreme Court review the actions of the title board with respect to the title, ballot title and submission clause, and summary fixed and determined for the proposal designated 1999 - 2000 #255.

As cause therefore, I submit that:

1. The proposal contains more than one subject and therefore does not conform to the requirements of subsection (5.5) of section 1 of article V of the state constitution. Pursuant to that constitutional provision, no titles or summary should have been set.

2. The title, ballot title and submission clause, and summary as fixed and determined for the proposal do not correctly and fairly express the true intent and meaning of the proposed addition to the Colorado Revised Statutes.

3. The title, ballot title and submission clause, and summary as fixed and determined for the proposal are likely to cause confusion and are misleading as to the content and fiscal impact of the proposed addition to the Colorado Revised Statutes.

WHEREFORE, petitioner requests that this Court review and reverse the decision of the title board with respect to this proposal.
